1. Purpose and seller
These terms and conditions govern sales concluded on the website shop.motorboat74.com and in-shop reservations made from this website, between the seller and any customer acting as a consumer. Purchases by professionals are governed by the professional Terms and Conditions of Sale of Motor Boat 74, published on motorboat74.com.
The seller is:
Motor Boat 74, a SARL with share capital of €10,000, registered with the RCS (Trade and Companies Register) of Annecy under number 920 936 713 (SIRET 920 936 713 00014), intra-EU VAT number FR85 920 936 713. Registered office: 315 rue de la Glière du Thermesay, Marlens, 74210 Val de Chaise.
Contact: 1099 Impasse du Semnoz, 74410 Saint-Jorioz, +33 4 57 57 27 27, contact@motorboat74.com.
Placing an order or making a reservation constitutes acceptance of these terms and conditions, in the version online at that time.
2. Products and availability
The essential characteristics of each product are presented on its product page. Availability is shown in real time: “in stock” (shipped, or ready at the shop, within 24 working hours) or “available to order” (ordered from the manufacturer, lead time confirmed to the customer before shipping). If a product turns out to be unavailable after the order, the customer is informed and refunded without delay the sums paid for that product.
3. Prices
Prices are stated in euros, inclusive of all taxes (incl. French VAT). Delivery charges are added according to the method chosen; their amount is displayed before the order is confirmed. Any displayed reduction is calculated by reference to the lowest price charged during the thirty days preceding its start (article L. 112-1-1 of the Code de la consommation, the French Consumer Code). The price invoiced is the price displayed when the order is confirmed.
4. Order and payment
The customer chooses their products, enters their contact details and delivery method, checks the summary (products, prices, delivery charges, total), then pays online through the payment provider CAWL (Crédit Agricole), on its secure payment page: by bank card and, depending on the methods offered on that page, by Apple Pay, Google Pay or in instalments. Paying in instalments is a credit granted by the financing company shown on the payment page, subject to its approval; the seller is paid in full. The seller never has access to card numbers. The sale is concluded upon confirmation of payment; a summary email is then sent to the customer. Orders placed with a customer account remain viewable in the customer area. The seller may refuse an order in the event of a previous payment dispute with the customer.
As long as online payment is not offered on the shop, the order is reserved without payment: the products are set aside for seven days and the seller calls the customer to arrange collection from the shop or delivery (with its delivery charge, stated before any payment) and payment, by bank transfer or at the Saint-Jorioz shop. The sale is concluded upon receipt of payment; the order is then prepared. If payment is not received within this period, the reservation is cancelled automatically, at no cost, and the products are put back on sale.
5. Reservation in the shop, without payment
An in-stock product may be reserved from its product page, without online payment. It is set aside at the Saint-Jorioz shop for seven days; the sale is concluded at the shop, upon collection and payment. If it is not collected within this period, the reservation is cancelled automatically and the product is put back on sale, at no cost to the customer. The customer may cancel or ask for more time by telephone or by email. As the reservation is followed by a purchase in the shop, the right of withdrawal applicable to distance selling does not apply to it.
6. Delivery
The shop delivers to mainland France. Methods, prices and indicative lead times from dispatch:
- Small parcels to a pickup point: €4.90, free on orders of €79 or more, 3 to 5 working days.
- Small parcels, home delivery: €8.90, free on orders of €149 or more, 2 to 3 working days.
- Long or bulky parcels (skis, wakeboards, wakesurf boards, towable tubes, stand-up paddle boards, bags), home delivery: €19.90, free on orders of €500 or more, 2 to 4 working days.
- Collection from the Saint-Jorioz shop: free, ready within 24 hours for an in-stock product.
An in-stock product is shipped within 24 working hours; a product available to order, as soon as it is received. Unless a date has been agreed, delivery takes place no later than thirty days after the order. In the event of delay, the customer may, after giving the seller formal notice to deliver within a reasonable period, terminate the sale and be refunded (articles L. 216-1 et seq. of the Code de la consommation). The risk of loss of or damage to the products passes to the customer when they take physical possession of them. The customer is asked to check the parcel on receipt and to report any anomaly to the carrier and to the seller.
7. Right of withdrawal
The law gives consumers fourteen days to withdraw from a distance purchase, without having to give any reason. The shop extends this period to 30 days from receipt of the product. To exercise this right, the customer informs the seller of their decision by email to contact@motorboat74.com, by post, or by means of the form below, then returns the product no later than fourteen days after giving this notice, complete and in its original condition, to the shop’s address, or brings it back to the shop. Return costs: free for orders of €600 or more; below that amount, they are borne by the customer.
The seller refunds all sums paid, including the initial delivery charges (at the standard delivery rate), within fourteen days of being informed of the withdrawal, using the same means of payment; it may withhold the refund until it has received the product back or proof that it has been sent. The value of a product depreciated by handling other than what is necessary to establish its nature, characteristics and proper functioning may be withheld. The right of withdrawal does not apply to goods made to the customer’s specifications or clearly personalised, in particular a rope cut to the requested length (article L. 221-28 of the Code de la consommation).
Withdrawal form (complete and return this form only if you wish to withdraw from the contract)
To Motor Boat 74, 1099 Impasse du Semnoz, 74410 Saint-Jorioz, contact@motorboat74.com: I hereby give notice that I withdraw from my contract for the sale of the following goods: … Ordered on … / received on … Order number: … Name of consumer: … Address of consumer: … Signature (only if this form is notified on paper): … Date: …
8. Legal guarantees
All products benefit from the legal guarantee of conformity (articles L. 217-1 et seq. of the Code de la consommation) and from the guarantee against hidden defects (articles 1641 to 1649 of the Code civil, the French Civil Code), under the conditions set out below. To invoke them, the customer contacts the seller on +33 4 57 57 27 27 or at contact@motorboat74.com.
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity, and not the date on which it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them. If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in return for the goods, if: the professional refuses to repair or replace the goods; the repair or replacement of the goods takes place after a period of thirty days; the repair or replacement of the goods causes major inconvenience to the consumer; the lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity. The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the goods are returned in working order. The rights mentioned above derive from articles L. 217-1 to L. 217-32 of the Code de la consommation. A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 241-5 of the Code de la consommation).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the Code civil, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in return for the goods.
9. Personal data
The customer’s data is processed in accordance with the privacy policy.
10. Complaints, mediation and disputes
Any complaint should first be addressed to the seller, on +33 4 57 57 27 27 or at contact@motorboat74.com. Failing agreement, the consumer may refer the matter, free of charge, to the consumer mediator: [to be completed: consumer mediator].
These terms and conditions are governed by French law. The consumer may bring proceedings, at their choice, before the court for the place where they were resident when the contract was concluded or when the harmful event occurred, or before any other competent court.
